Acquitted member of Liberty City Seven deported to Haiti

On Thursday, the one year moratorium expired on deportations to Haiti.  On the first plane back was Lyglenson Lemorin.  Mr. Lemorin made headlines for his 2007 acquittal of terrorism charges in the infamous case known as the "Liberty City Seven." 

In 2006, the seven individuals were arrested for plotting with al Qaeda to blow up the Sears Tower in Chicago.  Mr. Lyglenson was acquitted of all charges.  Unfortunately for him, the Patriot Act gave Immigration the authority to remove any individual who gave "material support" to a terrorist group, even without a conviction.

This case has 2 elements that I think are important. 

#1, although Mr. Lyglenson was acquitted of any wrongdoing, he was still deported.  Very sad. 

#2, Haiti is still in shambles, deporting criminal aliens is not doing them any favors (most of the Haitian community agrees!)

Mr. Lyglenson was represented vigorously by Atlanta Immigration Attorney Charles Kuck.  Mr. Kuck took this case all the way to the 11th Circuit Court of Appeal.  That appeal is still pending.

B1/B2 visa, what happens if I overstay my time?

If you have been admitted into the United States with a B1/B2 visa and have decided to overstay, you could be subjecting yourself to trouble.  Overstaying on your visa is a big problem because it may subject you to a 3 year or 10 year bar from re-entering the United States.  Overstaying may also cause problems if you subsequently file for adjustment of status.

Cancellation of Removal

I'm writing today about Cancellation of Removal.  Cancellation (for short), is a form of relief available to those individuals who are in removal (deportation) proceedings.  Cancellation is available to lawful permanent resident or non-residents.  If you are a non-resident, you need 10 years of domicile in the United States, good moral character and exceptional and extreme hardship to a qualifying relative (spouse or child who is either a US Citizen or a resident.)  A resident will only need 7 years of domicile in the United States along with the additional requirements. 

Generally, Cancellation of Removal is a complicated case with additional factors that should be looked into to determine whether you qualify.  If you are in removal proceedings, give me a call or email me.  I would gladly discuss your case with you.

CBP agent killed in Arizona
